The plaintiff-appellant, Ludwig Menzl, d/b/a Menzl's Towing Service (hereinafter referred to as Menzl), commenced a mandamus action claiming that he was the lowest qualified bidder and that the city of Milwaukee's towing contract should be awarded to him. The circuit court for Milwaukee county found that the contract in question was not subject to the compulsory competitive bid section of the Milwaukee city charter and that the commissioner of public works was at liberty to reject all bids and to readvertise on the basis of new specifications, and therefore denied the writ of mandamus. In 1962, Menzl entered into a contract with the city of Milwaukee to remove wrecked and disabled vehicles from the city streets. This contract was for a three-year period, but permitted the city to extend the contract until a new contract was let. On January 10, 1966, the commissioner of public works advertised for bids for a new towing contract. The specifications called for a three-year contract providing for the removal of wrecked, disabled, abandoned, stolen, and police-evidence vehicles from the streets and their storage until sold or otherwise disposed of by city authorities.
